Promulgation of the Anti-Terrorism Legislative Decree 046
On March 10, 1981, the Peruvian government, under the authority of Law 23230, promulgated Legislative Decree 046, which defined the crime of terrorism and established procedural norms for such cases. This decree was introduced amidst the rise of subversive activities by the group Sendero Luminoso, which created significant political tension and confusion. The decree faced constitutional challenges from political sectors in Congress, as it was issued under a law intended for other matters.
El 10 de marzo de 1981, el Ejecutivo promulgó el Decreto Legislativo 046 amparado en la Ley 23230, que le había delegado facultades legislativas para modificar o derogar decretos leyes del gobierno militar. Este decreto tipificó el delito de terrorismo y estableció las normas procesales para estos casos. El decreto fue cuestionado por sectores políticos del Congreso tanto por la forma en que fue promulgado, utilizando una ley expedida para otras materias, como por aspectos de su contenido.
