Debate on Terrorism and Legislative Decree 046
In March 1981, the Peruvian government issued Legislative Decree 046, which defined and established procedural norms for the crime of terrorism. This legislative action was part of a broader debate among political leaders about the nature and extent of terrorism in the country. While some officials, like Senator Alva, advocated for military intervention, others, including Minister De la Jara, argued that existing police forces were sufficient to manage the threat without suspending constitutional guarantees.
En 1980, funcionarios del gobierno peruano debatieron sobre la caracterización de los actos violentos como terrorismo. Mientras algunos, como el senador Alva, propusieron crear zonas de emergencia e intervención militar, el ministro del Interior y otros líderes políticos consideraban exagerado calificar ciertos actos como terrorismo. Previamente, en marzo de 1981, el gobierno dictó el Decreto Legislativo 046 que tipificaba el delito de terrorismo y establecía las normas procesales correspondientes.
