Application of Amnesty Law in the Santa Barbara case
Criminal Court applied the Amnesty Law by closing the case against the military responsible for the Santa Barbara massacre.
The Criminal Chamber of the Superior Court of Huancavelica declared Amnesty Law No. 26479 applicable to the process followed against Lieutenant EP Javier Bendezú Vargas and his subordinates, ordering the cutting of the sequel of the process and its definitive archiving. They also annulled the judicial and police records of the six defendants who benefited from the amnesty. This decision was confirmed by the First Transitory Criminal Chamber of the Supreme Court on January 14, 1997.
