Amnesty vs. Human Rights. Seeking Justice
This Ombudsman's report presents the background and the political, institutional, and legal context in which the amnesty laws were enacted, along with the parameters for evaluating, analyzing, and resolving the serious human rights violations in Peru. It also analyzes the limits of amnesty within the framework of the constitutional and democratic rule of law, the constitutional prerequisites that must necessarily be taken into account in any proposed solutions, as well as the scope of the Constitutional Tribunal's ruling on the unconstitutionality claim brought against the norms in question and its effects on the possibility of exercising diffuse constitutional review.
