Implementation of the 1992 Anti-Terrorism Legislation in Peru
In 1992, Peru implemented anti-terrorism legislation, specifically through Decree Law No. 25475, which expanded the investigative powers of the National Police in terrorism cases. The law allowed the police to conduct investigations without external restrictions and limited the role of the Public Ministry, reducing it to a mere observer of police actions. Additionally, the law mandated that judges issue an auto de apertura de instrucción upon receiving a police report, effectively removing judicial discretion in the early stages of legal proceedings.
El Decreto Ley N° 25475 de 1992 ratificó el rol protagónico de la Policía Nacional permitiéndole asumir la investigación de delitos de Terrorismo a nivel nacional sin restricciones más allá de sus reglamentos institucionales. La legislación limitó seriamente la labor del Ministerio Público, cuyo rol constitucional requería conducir la investigación desde el inicio, reduciendo su función a fedatario de la legalidad de las actuaciones policiales. El artículo 13° del Decreto Ley N° 25475 obligaba a los jueces a emitir auto de apertura de instrucción en 24 horas al recibir denuncias policiales, convirtiéndolos en meros tramitadores sin potestad para denegar la apertura, aunque no existiera material probatorio suficiente.
