Destitution of the Tribunal of Constitutional Guarantees in Peru
On April 8, 1992, the Peruvian government promulgated Decree Law N° 25422, which resulted in the dismissal of all members of the Tribunal of Constitutional Guarantees. Although the tribunal continued to exist formally, it became inoperative, leading to significant delays in the processing of constitutional guarantees and negatively impacting the protection of human rights. This event highlighted the challenges faced by the judiciary in maintaining independence and protecting individual freedoms during periods of political instability.
Como consecuencia del establecimiento del Gobierno de Facto, se promulgó el Decreto Ley Nº 25422 del 8 de abril de 1992, que destituyó a la totalidad de los miembros del Tribunal de Garantías Constitucionales. Aunque se dispuso el cese de todos sus miembros, el tribunal continuó existiendo formalmente pero no funcionaba. Esta situación generó el entrampamiento en la tramitación de los procesos de garantías, con graves consecuencias en la protección de derechos humanos, lo que se suma a otros factores que hicieron inoperante el Sistema Judicial en la represión de la violencia y en la protección del debido proceso.
