Overturning of Peru's Amnesty Laws by the Inter-American Court of Human Rights
In the 1990s, the Peruvian government under President Alberto Fujimori enacted a series of amnesty laws that granted immunity to military and civilian personnel involved in human rights violations during the internal armed conflict. These laws were heavily criticized for obstructing justice and protecting perpetrators of serious crimes. On March 14, 2001, the Inter-American Court of Human Rights declared these laws null and void, stating they were incompatible with international human rights standards and hindered the investigation and punishment of those responsible for grave human rights violations.
Durante el gobierno de Fujimori, se promulgaron tres leyes de amnistía (N° 26479, 26492 y 26700) diseñadas para proteger de la justicia a militares y civiles involucrados en violaciones graves de derechos humanos durante el conflicto armado interno. Estas leyes fueron cuestionadas por la comunidad nacional e internacional. La Corte Interamericana de Derechos Humanos, en su sentencia del 14 de marzo de 2001 en el Caso Barrios Altos, declaró nulas estas disposiciones por ser inadmisibles y contrarias a derechos inderogables reconocidos por el Derecho Internacional, estableciendo que las leyes eran incompatibles con la Convención Americana sobre Derechos Humanos.
