El 14 de marzo de 2001, la Corte Interamericana falló por unanimidad que las leyes de amnistía 26479 y 26492 eran incompatibles con la Convención Americana sobre Derechos Humanos y, en consecuencia, carecían de efectos jurídicos. Esta sentencia cuestionó las medidas legales que se habían adoptado durante el conflicto interno peruano, las cuales habían buscado expandir los márgenes de discrecionalidad de las fuerzas armadas y policiales.
