Promulgation of the New Regulation of the Penal Execution Code
During the Transitional Government of Valentín Paniagua, a new regulation for the Penal Execution Code was promulgated on 20 July 2001 through Supreme Decree No. 023-2001-JUS. This regulation aimed to address the discretionary power of penitentiary officials and provide clear guidelines for the operation of the penitentiary system. However, the regulation has not yet come into effect, and the normative gap continues to be a subject of discussion.
Durante el Gobierno de Transición de Valentín Paniagua, el 20 de julio del 2001 se promulgó el nuevo Reglamento del Código de Ejecución Penal mediante Decreto Supremo Nº 023-2001-JUS. Esta norma reglamentaria buscaba precisar los alcances y contenidos del Código de Ejecución Penal, proporcionando a los operadores del sistema penitenciario lineamientos claros de actuación e instrumentos públicos para fiscalizar a los funcionarios penitenciarios. Sin embargo, el reglamento no entró en vigencia y la vacancia normativa se amplió sucesivamente, continuándose la discusión de nuevos textos reglamentarios.
