Promulgation of the New Penal Execution Code Regulation
On July 20, 2001, the new Regulation of the Penal Execution Code was promulgated in Peru through Supreme Decree Nº 023-2001-JUS. However, its implementation has been repeatedly postponed due to successive decrees. A report by the United Nations Development Programme and the Ministry of Justice of Peru in July 2002 highlighted technical defects in the code that could violate fundamental rights, and criticized the lack of a penitentiary regulation, leading to a discretionary and potentially arbitrary administration.
El 20 de julio del 2001, se promulgó el nuevo Reglamento del Código de Ejecución Penal mediante Decreto Supremo Nº 023-2001-JUS. Sin embargo, este no entró en vigencia y se amplió la vacancia normativa sucesivas veces mediante diversos decretos supremos. Según un informe del PNUD y el Ministerio de Justicia de 2002, el código contenía importantes defectos técnicos que vulneraban derechos fundamentales, y la ausencia de su reglamento penitenciario junto con legislación de emergencia generó un panorama normativo desolador que permitía excesiva discrecionalidad en la administración penitenciaria.
