Reform of the Penal Code in 1991
In 1991, the Penal Code was reformed to abolish the system of objective responsibility, confirming the principle of subjective responsibility or culpability. The reform emphasized that only intentional or negligent acts or omissions could be sanctioned as crimes or offenses. This change aimed to align the penal system with constitutional principles, focusing on reeducation, rehabilitation, and reintegration of offenders into society.
El Código Penal de 1991 marcó un cambio importante al establecer en su artículo VII del Título Preliminar la proscripción de toda forma de responsabilidad objetiva. Esta reforma confirmó explícitamente el principio de responsabilidad subjetiva o de culpabilidad, regulando que solo se sancionen como delitos y faltas los actos u omisiones dolosas o culposas. La reforma también mantuvo la pena de cadena perpetua, aunque se cuestionó su compatibilidad con los principios constitucionales de reeducación y rehabilitación penal.
