The 1986 El Frontón Prison Incident
In 1986, the Peruvian government declared a state of emergency in Lima and El Callao, leading to the designation of the San Juan Bautista Prison as a restricted military zone. During this period, Nolberto Durand Ugarte and Gabriel Pablo Ugarte Rivera were among those affected by the suppression of prison riots. Their families filed a Habeas Corpus petition to investigate their whereabouts, but it was repeatedly dismissed by various judicial bodies, ultimately reaching the Inter-American Court of Human Rights.
El 30 de junio de 1986 se publicó el Decreto Supremo 006-86-JUS que declaró Zona militar restringida el Penal San Juan Bautista (El Frontón). Durante los motines en esta zona, desaparecieron los procesados Nolberto Durand Ugarte y Gabriel Pablo Ugarte Rivera, quienes no figuraron en listas de sobrevivientes ni de muertos. Los familiares interpusieron habeas corpus el 26 de junio de 1986, pero fue rechazado por todas las instancias judiciales nacionales, incluyendo el Tribunal de Garantías Constitucionales. Tras los rechazos nacionales, ambos casos fueron llevados ante la Corte Interamericana de Derechos Humanos.
