Amendment of Death Penalty Regulations in Peru
In 1993, the Peruvian Constitution was amended to expand the conditions under which the death penalty could be applied. While the 1979 Constitution allowed the death penalty only for treason during external war, the 1993 amendment extended this to include treason during internal war, specifically in cases of terrorism. Despite this constitutional change, no corresponding penal law was enacted, and the application of the death penalty remains contrary to the American Convention on Human Rights.
La Constitución de 1979 prohibía la pena de muerte excepto por traición a la patria en guerra exterior. La Constitución de 1993 amplió esta causal mediante el artículo 140, extendiéndola al delito de traición a la patria en caso de guerra interna e incorporando la hipótesis de terrorismo. A pesar de esta modificación constitucional, no se aprobó ley penal ordinaria que adecuase la norma, por lo que aunque se permite la ejecución judicial en el Perú, esta no se ha aplicado. Esta regulación contradice la Convención Americana sobre Derechos Humanos, que prohíbe restablecer la pena de muerte en países que la hubieran abolido.
