Creation of the crime of treason

In August 1992, the crime of treason was created, which punished with life imprisonment leaders of subversive groups or those who collaborated with terrorist attacks. This legislation violated principles of due process by establishing open-ended criminal offenses and allowing arrests without warrants.

In August 1992, the Peruvian Executive Branch created the crime of treason through anti-terrorist legislation. This crime punished with life imprisonment the leaders or leaders of subversive groups or those who participated in or collaborated with the carrying out of attacks through the use of explosive or similar materials. This legislation was enacted in the context of the Government of Emergency and National Reconstruction established after the self-coup of April 5, 1992. The new legislation violated the principles of due process and judicial guarantees by establishing open criminal offenses, introducing the figure of "faceless judges" in both the common and military courts, and allowing detention without the need for a warrant or flagrante delicto.
