Judgment of the Inter-American Court of Human Rights in the Barrios Altos Case
In the Barrios Altos case, the Inter-American Court of Human Rights issues the present Judgment: 1. To accept the acknowledgment of international responsibility made by the Peruvian State. 2. To declare, in accordance with the terms of the acknowledgment of international responsibility made by the State, that it violated a) the right to life b) the right to personal integrity c) the right to judicial guarantees and judicial protection. 3. To declare, in accordance with the terms of the acknowledgment of responsibility made by the State, that it failed to comply with Articles 1.1 and 2 of the American Convention on Human Rights. 4. To declare that Amnesty Laws No. 26479 and No. 26492 are incompatible with the American Convention on Human Rights and therefore lack legal effect. 5. To declare that the State of Peru must investigate the facts to identify those responsible for the human rights violations referred to in this Judgment, as well as publicly disclose the results of such investigation and punish those responsible. 6. To order that reparations shall be determined by mutual agreement between the respondent State, the Inter-American Commission, and the victims, their families, or their duly accredited legal representatives, within a period of three months from the date of notification of this Judgment. 7. To reserve the authority to review and approve the agreement referred to in the preceding operative paragraph and, in the event that no agreement is reached, to continue the reparations proceedings.
