On the Punishment of Former President Alberto Fujimori as Indirect Perpetrator of a State Criminal Organization
The value of the ruling against Alberto Fujimori lies not only in the fact of identifying and articulating the prerequisites for criminal imputation as an indirect perpetrator, but also represents a valuable effort to construct a dogmatic category that allows for the punishment of crimes linked to the fundamental rights of the person. The Special Criminal Chamber has established the degree of organization and belonging of Alberto Fujimori to an organized power apparatus that, from the Peruvian State, proceeded to implement a counter-subversive policy that systematically violated Human Rights.
