Reflections on the legal framework on sexual violence before, during and after the Peruvian internal armed conflict.

Sexual violence during the Peruvian armed conflict is one of many stories of violence suffered by Peruvian women in periods before and after the conflict. Sexual violence in the armed conflict, then, is not simply a human rights violation, nor the starting point of a series of violent behaviors toward women. It is a consequence of discriminatory practices that exclude them from the system, and that are condoned by the State when it fails, by action or omission, to fulfill its obligation to act with due diligence. This study aims to be a starting point for discussing the issues raised above, and to serve as a basis for the legal work that DEMUS (Estudio para la defensoría de los derechos de la mujer) carried out in the community of Manta, in the province and department of Huancavelica. Manta was one of the localities cited in the Final Report of the Comisión de la Verdad y Reconciliación (CVR) as one of those that suffered sexual violence against its women in an almost systematic manner between the years 1980 and 2000.
