Promulgation of Law 24150 in Peru
On June 6, 1985, the Peruvian Congress passed Law 24150, which established norms for states of exception where the military assumed control over internal order. This law effectively legalized the military's discretionary power over civil authority, a practice that was already occurring. The law was a response to the threat posed by the insurgent group Sendero Luminoso, but it exceeded constitutional limits by establishing military political control, which was not defined in international or constitutional norms.
El 6 de junio de 1985, durante la transferencia de gobierno, el Congreso promulgó con los votos de AP y PAP la Ley 24150, que establecía las normas a cumplir en los estados de excepción en que las FFAA asumían el control del orden interno. Este dispositivo legalizó prácticas ya existentes, inhibiendo la autoridad civil en beneficio de la militar, otorgándole amplia discrecionalidad y autonomía respecto al poder constituido. La norma fue cuestionada por invadir el principio de soberanía política más allá de su fin constitucional de proteger el Estado de Derecho durante perturbaciones graves al orden público.
