Law No. 24700 on Anti-Terrorist Procedures

First law that established specific preliminary investigation and trial procedures for terrorist crimes in Peru, granting the Provincial Prosecutor the direction of the investigation with police participation under his command, although with provisions that affected judicial independence.

Law 24700 was the first legal provision establishing procedures for the preliminary investigation and prosecution of terrorist crimes. This norm established an investigation scheme adjusted to the constitutional program of the political charter of 1979, prescribing that the Provincial Prosecutor would be directly in charge of the investigation in defense of legality, human rights and the interests protected by law, while members of the police forces would participate in the proceedings previously ordered by the Prosecutor. The law also provided that incommunicado detention would not prevent private conferences between the defense attorney and the detainee. However, it contemplated rules that affected the principles of independence and impartiality of the judge, establishing that the proceedings carried out by the police would not be repeated in the investigation and limiting the grounds for recusal of judges.
