Judgment of the Special Court on the Uchuraccay Case

The Special Court sentenced three peasants from Uchuraccay to 6, 8 and 10 years in prison for simple homicide in connection with the death of eight journalists in 1983. The sentence recognized that the defendants were semi-literate peasants subjected to a context of generalized violence.

The Special Court sentenced three peasants from Uchuraccay for the murder of eight journalists on January 26, 1983. Dionisio Morales Pérez was sentenced to 10 years in prison, Mariano Ccasani Gonzáles to 8 years and Simeón Auccatoma Quispe to 6 years, all for the crime of simple homicide. Although the prosecutor had requested 25 years of imprisonment for aggravated homicide, the court determined that there were no elements to attribute to them the intention of deliberately increasing the suffering of the victims, considering that they were semi-literate peasants with no criminal record subjected to a generic state of violence. The sentence declared that the presence of military and police personnel in Uchuraccay on the day of the massacre was proven, based on various evidence and testimonies.
