Inter-American Commission on Human Rights Report on Argentina
The Inter-American Commission on Human Rights, in its report 55/97, addressed the protection of the right to life under both the common Article 3 and Article 4 of the American Convention. The report emphasized the prohibition of summary executions under any circumstances and highlighted the Commission's competence to address allegations of arbitrary deprivation of life by state agents. The report also discussed the limitations of the American Convention in distinguishing between civilians and combatants in armed conflicts.
La Comisión Interamericana de Derechos Humanos, en su Informe 55/97 del 18 de noviembre de 1997 sobre el Caso 11.137 en Argentina, afirmó que tanto el artículo 3 común como el artículo 4 de la Convención Americana protegen el derecho a la vida y prohíben las ejecuciones sumarias. La Comisión declaró que durante el enfrentamiento violento entre atacantes y las fuerzas armadas argentinas, a pesar de su corta duración de 30 horas, se activó la aplicación del artículo 3 común y otras normas relevantes para la conducción de conflictos internos. Se precisó que la aplicación del Derecho Internacional Humanitario durante un conflicto armado interno no afecta el estatuto jurídico nacional o internacional de los grupos insurgentes o sus miembros.
