El Estado peruano ratificó los principales tratados universales y regionales del Derecho Internacional de los Derechos Humanos, participando activamente en los sistemas de Naciones Unidas e Interamericano de protección de derechos humanos. La Declaración Universal de los Derechos Humanos de 1948 fue aprobada por el Perú mediante Resolución Legislativa N° 13282 expedida el 15 de diciembre de 1959.
