Creation of the Truth and Reconciliation Commission (CVR) in Peru
In 2000, the Peruvian government initiated the process of establishing the Truth and Reconciliation Commission (CVR) to address crimes committed during the internal conflict. The Ministry of Justice recognized these crimes as 'grave violations of Human Rights and International Humanitarian Law.' The commission aimed to apply both national and international legal standards to ensure comprehensive accountability, despite challenges in categorizing subversive groups under international law.
La CVR fue establecida por Decreto Supremo Nº 002-2002-JUS publicado el 15 de enero de 2002. La Comisión identificó situaciones de vulnerabilidad diferenciada entre las víctimas y elaboró medidas de reparación orientadas a equilibrar asimetrías, con atención especial a personas de tercera edad, huérfanos, viudas y personas discapacitadas. El otorgamiento de beneficios a través del Plan Integral de Reparaciones (PIR) dejaba sin efecto demandas civiles contra el Estado, mientras se reservaba el derecho de repetición contra los responsables de violaciones de derechos humanos.
