Constitution of Peru 1993 - State of Emergency Provisions
The 1993 Constitution of Peru outlines the conditions under which the President, with the agreement of the Council of Ministers, can declare a state of emergency. This can occur in cases of disturbance of peace, internal order, catastrophe, or severe circumstances affecting the nation. During such a state, certain constitutional rights may be restricted or suspended, but the duration cannot exceed sixty days without a new decree.
La Constitución Política de 1993, en su Artículo 137º, faculta al Presidente de la República, con acuerdo del Consejo de Ministros, a declarar estados de emergencia por plazo determinado en todo o parte del territorio nacional. Durante estos estados, pueden restringirse o suspenderse derechos relativos a la libertad y seguridad personales, inviolabilidad del domicilio, y libertad de reunión y tránsito. El plazo del estado de emergencia no excede sesenta días, requiriendo nuevo decreto para prórroga, y las Fuerzas Armadas pueden asumir control del orden interno según disponga el Presidente.
