Report of the United Nations Working Group on Arbitrary Detention on its Mission to Peru

Report of the United Nations Working Group on Arbitrary Detention on its mission to Peru, which criticized Peruvian anti-terrorist legislation, especially the crime of treason, describing it as an abuse of language and pointing out the use of open criminal definitions with vague terms.

The United Nations Working Group on Arbitrary Detention issued a report on its mission to Peru, evaluating the situation of detentions and anti-terrorist legislation. The report noted that the crime of treason as a crime in law has nothing to do with terrorism, calling it an obvious abuse of language for purposes contrary to what the criminal law proposes. The Working Group specifically analyzed the provisions of Decree Law 25659 and its application, concluding that they were open criminal types that used very diffuse terms, contrary to what modern criminal systems require. This report was cited by the TRC as part of its analysis of due process violations during the internal armed conflict.
