Reopening of Investigations into the Death of Hugo Bustíos Saavedra
On 8 March 2002, investigations were reopened into the death of journalist Hugo Bustíos Saavedra and the physical abuse of Eduardo Rojas Arce. This action was taken following a request by the Inter-American Commission on Human Rights and the Provincial Mixed Prosecutor's Office of Huanta. The aim was to identify the responsible parties and determine the circumstances surrounding the incidents that occurred in 1988.
El 12 de marzo de 1991, el Fiscal Provincial de Huanta formalizó denuncia penal contra el Teniente Coronel Víctor Fernando La Vera Hernández, acusándolo de homicidio y lesiones graves contra Hugo Bustíos Saavedra y Eduardo Yeny Rojas Arce. La investigación fiscal identificó a La Vera Hernández como autor de los hechos ocurridos en 1988 en el pago Erapata, utilizando el nombre falso de "comandante Javier Landa Dupont", y estableció que solo se encontraban presentes efectivos militares y policiales. El 29 de mayo de 1991 se abrió instrucción en el Juzgado Penal de Huanta y se amplió la denuncia para incluir al Mayor Amador Vidal Sambento. Sin embargo, el 12 de mayo de 1993, el Juez Penal declaró fundada la Excepción de Cosa Juzgada y archivó la causa.
