The Excess Theory and the Supreme Court
The case of the massacre of Parcco and Pomatambo (Vilcashuamán, Ayacucho), perpetrated by elements of the Army on October 23, 1986, is not only an emblematic example of the crimes against humanity committed during those years, but now also appears to be becoming a turning point in national jurisprudence in the area of human rights. To what extent this ruling may ultimately signify a change in the orientation of the Supreme Court's jurisprudence on human rights matters, and an event serving a political strategy that has long sought to definitively close investigations into serious human rights violations, remains to be seen in the very near future.
