Military Justice and Judicial Independence in Peru: Regulations, Jurisprudence, and the Work of the Ombudsman's Office
Since the beginning of its functions in 1996, the Defensoría del Pueblo has noted that the regulatory design of Military Justice in our country presented compatibility problems with constitutional requirements and the international obligations of the Peruvian State regarding human rights. This document sets out the main observations raised by the Defensoría del Pueblo, as well as the jurisprudential criteria established by the Constitutional Court. It then develops a set of aspects that, in the view of the Defensoría del Pueblo, are essential for assessing the constitutional compatibility of current military and police criminal legislation.
