Parameters for the Design of a Reparations Program in Peru
This report does not aim to offer a prescription for Peru or to pronounce on specific measures that must be defined among Peruvians. Its objective is more modest: it seeks to contribute, from a theoretical perspective and drawing on international experience, to defining a fair and realistic framework within which Peruvian society can debate the best way to repair the incalculable harm caused to individuals and communities during 20 years of violence and repression. The debate on reparations does not occur in a vacuum; it must align with certain international and national standards and has the opportunity to draw on the experience of other countries that have faced a similar challenge. For this reason, the report includes an analysis of the relevant legal considerations and the experience of other truth commissions, while keeping in view the Peruvian legal, social, and economic context.
