Modification of Anti-Terrorism Law in Peru
On June 2, 1989, Peru enacted Law N° 25031, which modified the existing Law N° 24700. This legislation transferred the responsibility for investigating terrorism-related crimes back to the Police of Investigations of Peru. In areas lacking this police force, other police forces were tasked with the investigations. The law also mandated that a special judge, designated by the respective Superior Courts, should oversee the instruction of these cases.
La Ley N° 25031, publicada el 2 de junio de 1989, modificó parcialmente la Ley N° 24700 relativa a procedimientos en casos de terrorismo. La normativa estableció que la investigación policial de delitos terroristas sería realizada por la Policía de Investigaciones del Perú, o por otras fuerzas policiales en zonas donde aquella no estuviera presente. Además, la instrucción debería ser asumida por un juez especial designado por las Cortes Superiores respectivas. Esta modificación se produjo en el contexto de una limitada estrategia legal antisubversiva del Congreso 1985-1990 frente a la amenaza de Sendero Luminoso y el MRTA.
