Presentation of the Human Rights Commission Report on Pucayacu and Accomarca
In October 1985, the Human Rights Commission of the Peruvian Senate presented two reports regarding the events in Pucayacu and Accomarca. The majority report, led by Javier Valle Riestra, concluded that these events were part of a counter-subversive policy that violated human rights and recommended legislative changes to prevent military jurisdiction over such cases. The minority report, however, argued that it was not the Commission's role to determine the jurisdiction, leaving it to the judiciary. The political tension surrounding these reports led to Valle Riestra's resignation from the Commission.
La Comisión de Derechos Humanos del Senado, presidida por Javier Valle Riestra, presentó dos dictámenes en octubre de 1985 sobre los hechos de Pucayacu y Accomarca. El dictamen de mayoría concluyó que estos hechos constituían una política contrasubversiva violatoria de derechos humanos y delitos comunes, recomendando la prohibición del fuero militar en casos de tortura, ejecuciones extrajudiciales y desapariciones. El dictamen en minoría, suscrito por Andrés Quintana Gurt y Felipe Osterling, argumentó que la calificación de los delitos correspondía al Poder Judicial. Días después de presentado el informe, Valle Riestra renunció a la Comisión el 30 de octubre.
