Inappropriateness of the withdrawal of the prosecutor's indictment in the Uchuraccay case

On June 21, 1985, the Superior Court of Ayacucho declared the withdrawal of the prosecutor's accusation against the three peasants arrested for the Uchuraccay massacre inadmissible, rejecting the prosecutor's request for lack of evidence. This decision allowed the judicial process to continue against the accused.

On June 21, 1985, the withdrawal of the prosecutor's indictment against the three peasants arrested for the Uchuraccay massacre was declared inadmissible. This judicial decision came after prosecutor Oscar Guerrero surprisingly requested, during the hearing of March 26, 1985, the withdrawal of the accusation against the three accused and their immediate release, arguing that their participation in the massacre had not been proven. The prosecutor's request had generated an angry protest from the relatives of the journalists present in the courtroom, and the judge immediately dismissed the request. Subsequently, on June 21, 1985, the withdrawal was formally declared inadmissible, allowing the judicial process to continue against Dionisio Morales Pérez, Mariano Ccasani Gonzáles and Simeón Auccatoma Quispe.
