Law 23414 on the transfer of competence

Law that regulated the transfer of judicial competence in cases of related crimes, allowing the judge or court to transfer cases at the request of the Public Prosecutor's Office or ex officio when it is convenient for the administration of justice or the safety of the defendant.

Law 23414, published on June 1, 1982, regulated the transfer of jurisdiction in criminal cases during the government of Fernando Belaúnde (1980-1985). This law provided that the judge or court hearing a criminal proceeding or a more serious crime in cases of related crimes could decide to transfer jurisdiction at the request of the Public Prosecutor's Office or ex officio, with the prior opinion of the Prosecutor, when the circumstances made it convenient for the administration of justice or the safety of the defendant. This rule was part of the anti-terrorist legislative framework of the 1980s, establishing mechanisms to reorganize judicial competence in cases related to terrorism and related crimes.
