Case of Castillo Petruzzi and Others
The Inter-American Court of Human Rights declared the trial of Castillo Petruzzi and others before the Military Justice invalid and ordered a new trial. The Supreme Council of Military Justice annulled the previous sentence, and the case was moved to the Judicial Power for a new trial. The court emphasized the need for the new trial to fully observe due legal process and align with international human rights obligations.
La Corte Interamericana, mediante sentencia de 30 de mayo de 1999, declaró no válido el juzgamiento ante la Justicia Militar en el caso Castillo Petruzzi y otros, ordenando un nuevo juicio con plena observancia del debido proceso legal. El Consejo Supremo de Justicia Militar acató esta decisión procediendo a anular su sentencia. Actualmente el juicio se desarrolla ante el Poder Judicial. La Corte estableció que las normas aplicadas colisionaban con la Constitución de 1993 y violaban obligaciones internacionales del Estado consagradas en la Convención Americana de Derechos Humanos.
