Enactment of the Código de Ejecución Penal
The Penal Enforcement Code was enacted in 1984 as the first comprehensive legal framework addressing the penitentiary system in Peru. It developed the constitutional norms established in the 1979 Constitution, focusing on the reeducation, rehabilitation, and reintegration of inmates into society. This legal code replaced the previous, fragmented regulations and established systematic guidelines for the rights and duties of inmates, as well as the penitentiary regime and services.
El Código de Ejecución Penal de 1984 fue el primer cuerpo normativo que abordó sistemáticamente el conjunto del sistema penitenciario peruano, incluyendo derechos y deberes de los internos, régimen penitenciario, tratamiento y servicios penitenciarios. Este código desarrolló la norma constitucional establecida en el artículo 234º, segundo párrafo, de la Constitución de 1979, que señalaba que el régimen penitenciario tiene por objeto la reeducación, rehabilitación y reincorporación del penado a la sociedad. Antes de su promulgación regía el Decreto Ley Nº 17581 del 15 de abril de 1969 y diversas normas reglamentarias inconexas.
