Constitutional Court Ruling on Special Pardon
Constitutional Court decision that established the concept of special pardon as recognition of judicial error for innocent persons unjustly convicted during the internal armed conflict.
The Constitutional Court issued a ruling on Case No. 1277-99-AC/TC that established the concept of special or reasoned pardon as a form of recognition of a miscarriage of justice. The ruling stated that it is a sui generis type of benefit, applicable exclusively in cases in which an innocent person has been convicted or is presumed innocent. This judgment was relevant in the context of the arbitrary detentions and wrongful convictions that occurred during the internal armed conflict, particularly after the implementation of the 1992 anti-terrorist legislation.
