Medical Forensic Certificate N°3868-H - Examination of María Magdalena Monteza Benavides
Legal medical certificate that reported old tears and signs of old defilement in María Magdalena Monteza Benavides, as part of the investigation into her complaint of rape during her detention.
Forensic medical examination ordered by the 14th Criminal Court of Lima at the request of the representative of the Public Prosecutor's Office, performed on María Magdalena Monteza Benavides. The certificate was issued by the Institute of Legal Medicine of Peru and indicated as results old tears and "signs of old defilement". This examination was one of several performed on Monteza Benavides in the context of her complaint of rape during her detention by Army personnel. The CVR considered that these results did not rule out rape, since the 1992 legal medical examinations consisted of external examinations oriented according to the type of examination requested, and did not necessarily detect all the evidence of rape.
